HELEN HILLS FARM VOLUNTEER LIABILITY WAIVER AND RELEASE FORM

Volunteer Information:

INTRODUCTION: We are delighted to welcome volunteers to our farm. Your safety and well-being are of the utmost importance to us. Before volunteering, we ask that you carefully read and sign this waiver form, which outlines our guidelines and legal responsibilities.

AGREEMENT OF RESPONSIBILITY AND WAIVER OF LIABILITY:

I, the undersigned, understand that my participation as a volunteer at Helena Hills Farm involves various farm activities, which may include but are not limited to: gardening, handling tools and equipment, planting, working with livestock (e.g., chickens, ducks), lifting, and other physical tasks.

I acknowledge that these activities carry inherent risks, including the possibility of personal injury, property damage, or other unforeseen consequences. I agree to voluntarily assume all risks associated with my participation in volunteer activities at Helena Hills Farm.

In consideration of being permitted to volunteer, I hereby release, waive, and discharge Helena Hills Farm, its owners, employees, and agents from any and all claims or liability for injuries, damages, or losses that may occur as a result of my participation in any farm activities, whether caused by negligence or otherwise.

VOLUNTEER RULES AND GUIDELINES:

To ensure safety and order during volunteer hours, we ask all volunteers to adhere to the following rules:

  1. Follow Instructions: Always follow the instructions given by farm staff and supervisors.

  2. Protective Gear: Wear appropriate clothing and safety gear as instructed (e.g., gloves, boots, long sleeves).

  3. Tool Handling: Use tools and equipment responsibly and return them to their designated locations after use.

  4. Animal Handling: Be mindful and cautious when working around farm animals.

  5. No Unauthorized Tasks: Do not engage in any task for which you have not been trained or authorized.

  6. First Aid: Report any injury or accident immediately to the farm staff.

  7. Hydration and Breaks: Take breaks as needed and drink plenty of water, especially in hot weather.

  8. Respect the Environment: Stay within designated areas and be mindful of your surroundings to protect the farm’s crops and ecosystem.

SC AGRITOURISM LIABILITY LAW:

Under the South Carolina Agritourism Law, Helena Hills Farm is protected from liability for injuries or damages that occur on the property under certain conditions. South Carolina law recognizes that inherent risks are associated with farm and agritourism activities, and therefore, farms are not liable for injuries resulting from these inherent risks, provided that warning signs are posted and participants are informed.

Pursuant to South Carolina Code of Laws, Title 46, Chapter 53, this farm may not be held liable for any injury to, or death of, a participant in an agritourism activity conducted on this property if such injury or death results from the inherent risks of the activity. Inherent risks include, but are not limited to, hazards such as uneven terrain, interactions with animals, exposure to weather conditions, and equipment use.

MEDICAL TREATMENT CONSENT:

In the event of an emergency or injury, I hereby grant permission for Helena Hills Farm and its representatives to seek and secure medical treatment for me as deemed necessary. I agree to assume responsibility for all medical expenses incurred as a result of such treatment.


PHOTO AND MEDIA RELEASE:

I consent to and authorize Helena Hills Farm to use any photographs, video footage, or media taken during my volunteer work for promotional or educational purposes, including on social media, websites, or marketing materials.

SIGNATURE AND ACKNOWLEDGMENT:

I, the undersigned, have read and understand the terms of this Volunteer Liability Waiver and Release Form. I agree to comply with the rules and guidelines set forth and assume all risks associated with volunteering at Helena Hills Farm.
